Arizona's highest court has made a significant ruling.

The court has reinstated a law dating back to 1864 that effectively bans almost all abortions in the state. The decision has immediate ramifications for reproductive rights advocates and sets the stage for a contentious political battle leading up to the 2024 elections.

In a landmark decision on Tuesday, the Arizona Supreme Court greenlit the enforcement of a near-total abortion ban that had been dormant for decades following the legalization of abortion nationwide in the Roe v Wade ruling of 1973. The ruling allows the state to enforce the historic ban, but with a temporary hold for 14 days, during which advocates can seek legal recourse to challenge its implementation.

Under the 4-2 ruling, the ban can only be applied prospectively, meaning it does not apply retroactively. Arizona Attorney General Kris Mayes, a Democrat, swiftly announced that her office would not prosecute doctors or women under the 1864 ban, condemning the decision as a regression to an era when women lacked basic rights.

The ruling has galvanized both abortion rights supporters and opponents, setting the stage for a potential showdown at the ballot box in November. Advocates in Arizona have been mobilizing to gather signatures for a ballot measure aimed at enshrining abortion rights in the state constitution, intensifying their efforts in response to the court's decision.

Governor Katie Hobbs, also a Democrat, decried the ruling as a "dark day" for Arizona and urged supporters of reproductive rights to make their voices heard in the upcoming elections. Despite the court's decision, she pledged to do everything in her power to protect access to reproductive care in the state, including issuing an executive order last year to shield women and doctors from prosecution for seeking or performing abortions.

The immediate impact of the ruling on abortion access in Arizona remains uncertain, but providers have vowed to continue offering services for as long as legally permissible. Planned Parenthood Arizona, a prominent healthcare provider in the state, affirmed its commitment to providing essential healthcare within the confines of the law, emphasizing the importance of patient safety and support.

The court's decision has quickly become a focal point in the political arena, with candidates weighing in on both sides of the debate. Democrat Ruben Gallego, a candidate for the US Senate, condemned the law and vowed to protect abortion rights at the federal level. Meanwhile, Republican candidate Kari Lake, though previously staunchly anti-abortion, called for a common-sense solution to the issue and deferred to the voters to decide in November.

The implications of the ruling extend beyond Arizona's borders, with neighboring states like Texas closely watching the developments.
